1. About XM NETWORK

XM NETWORK provides website design, website development and digital marketing-related services. We operate independently and are not affiliated with, endorsed by, or sponsored by any third-party company or brand.

2. Seller terms and project agreement

These Terms & Conditions, the applicable service or pricing description, the Refund & Cancellation Policy, the Privacy Policy, and any project-specific written scope or order confirmation together describe the terms under which XM NETWORK provides services. Before payment is accepted, the customer should have an opportunity to review the applicable service description, price, cancellation/refund terms and privacy information.

By placing an order or authorizing payment, the customer confirms that the customer has reviewed the applicable terms and agrees to the project scope and price presented for that order, subject to applicable law and any separate written project agreement.

3. Services and project scope

Each package describes an intended scope. The exact deliverables, milestones, timeline, revision allowance, client responsibilities and exclusions will be confirmed in a written proposal, order confirmation or other written agreement. Work not included in the agreed scope may require a separate quote.

4. Pricing and one-time payments

Prices displayed on this website are in US dollars and are one-time project fees, not recurring subscriptions, unless a separate written agreement expressly states otherwise. A custom project price is agreed after discussion and written confirmation. Applicable taxes, domain and hosting charges, advertising spend, third-party software, premium assets and other external costs are excluded unless expressly stated.

XM NETWORK does not impose a separate surcharge merely because a customer chooses PayPal as a payment method. Any legitimate service or handling fee, if applicable, will be disclosed as part of the price before purchase and will not be presented as a PayPal surcharge.

5. Payment and payment security

Payment terms and any deposit or milestone schedule will be disclosed before a customer commits. Any additional work or price change must be approved by both parties in writing before it is charged.

Payments may be processed by PayPal or another third-party payment provider. The provider's own user agreement, privacy statement, dispute procedures, acceptable-use requirements and eligibility rules apply to its services. XM NETWORK does not claim to be affiliated with or endorsed by PayPal.

XM NETWORK does not ask customers to send full payment-card numbers, CVV/security codes, passwords or payment-account credentials by email or through the contact form. Customers should use the payment method and checkout process provided to them.

6. Project delivery and client responsibilities

Estimated timelines begin once required payment, content, access and approvals have been received. The customer is responsible for supplying accurate materials and having rights to use them. Delays in feedback, content or access may affect delivery dates. XM NETWORK will communicate material delivery issues when reasonably known.

7. Revisions, changes and acceptance

Included revision rounds are listed in the selected package or written scope. A revision means a reasonable adjustment to the agreed direction; a new feature, new page or materially different direction may be treated as additional work. We will obtain approval for additional fees before proceeding.

8. Cancellation and refunds

Our detailed Refund & Cancellation Policy is published separately and forms part of these Seller Terms. Customers should review it before purchase. Nothing in the policy or these terms limits non-waivable consumer rights or payment-provider dispute rights.

9. Payment disputes and chargebacks

If a customer believes a transaction is unauthorized, incorrect or otherwise disputed, the customer should contact XM NETWORK promptly so we can review the relevant project and payment records. XM NETWORK will cooperate with applicable payment-provider dispute and verification processes and may provide relevant transaction, delivery and communication records when lawfully requested.

10. No guaranteed marketing results

We do not guarantee specific search rankings, traffic, leads, sales, advertising approvals or financial outcomes. Results depend on factors outside our control, including platforms, competition, budgets, market conditions and customer inputs. Advertising spend is separate unless expressly included in writing.

11. Intellectual property

Unless otherwise agreed in writing, upon full payment the customer receives rights to the final custom deliverables created specifically for them, subject to third-party licences, open-source terms, stock asset licences and any pre-existing tools or materials. We retain ownership of our pre-existing methods, templates and reusable know-how.

12. Third-party platforms and services

Third-party platforms and services are governed by their own terms. We cannot control their availability, policy decisions, account reviews or changes. Customers are responsible for ensuring their business, content and use of third-party services comply with applicable requirements.

13. Acceptable use and lawful instructions

Customers must not ask XM NETWORK to create or publish content that is unlawful, fraudulent, deceptive, infringing, abusive or otherwise prohibited by applicable law or the relevant platform's rules. We may decline or stop work where necessary to comply with law, payment-provider requirements or platform policies.

14. Privacy and customer data

We process personal information as described in our Privacy Policy. If a payment provider supplies XM NETWORK with customer information in connection with a transaction, we will use that information only as reasonably necessary to administer the transaction, provide the purchased service, resolve disputes, comply with law, or otherwise as permitted by applicable law and the provider's terms. We will not use payment-provider customer information for unrelated marketing without the required consent.

15. Limitation of liability

To the extent permitted by law, XM NETWORK is not liable for indirect, incidental or consequential losses arising from a project. Nothing in these terms excludes liability that cannot legally be excluded. Any agreed liability limits must be set out in the written project agreement and comply with applicable law.

16. Changes to these terms

We may update these terms by posting a revised version on this website. The terms applicable to a particular paid project will be those agreed for that project, subject to applicable law.
